Emotional Support Animals

2015

State v. Welker, 5th Dist. Coshocton No. 2014CA0027, 2015-Ohio-2647.  Defendant owned emotional support ducks in violation of a West Lafeyette ordinance, because they helped him psychologically.  The court found that he violated the ordinance even though he registered the ducks as emotional support animals (via an emotional support animal website).

2011

Overlook Mut. Homes, Inc. v. Spencer, 415 Fed. Appx. 617 (6th Cir. 2011).  Defendant’s daughter had an emotional support animal, and their place of residence had a no-animal policy.  Although the court found that she should be allowed to have the animal under the FHA, they also found that the residence adequately tried to accommodate her.
