Euthanizing Animals

2014

State ex rel. Ohio SPCA v. Bd. of County Comm’rs, 4th Dist. Hocking No. 13CA2, 2014-Ohio-3348.  The SPCA (Society for the Prevention of Cruelty to Animals) wanted the court to compel the Hocking County Commissioners to halt the euthanizing of dogs by the gassing method and to use an injection method instead.  The court ruled in favor of the SPCA because the gassing method did not render the dogs immediately and painlessly unconscious before their death and was therefore inhumane according to R.C. 955.16.

2011

State ex rel. Ohio SPCA v. Bd. Of County Comm’rs, 7th Dist. Harrison No. 10-HA-2, 2011-Ohio-6029.  The SPCA was successful in having a writ issued to make sure no unnecessary animals were euthanized by the dog pound.  The dog pound, for the most part, was found to be running in accordance with statutory guidelines, except for a few minor violations (record keeping, notice of redemption, and public notice of hours).
